Timothy A. Rowe was born in Mansfield, Ohio. He graduated from the College of Emporia with a degree in Biblical Studies. He also attended the University of California Berkeley and Indiana University. He graduated with a B.A. with distinction in History and Classics from Indiana University in 1981 and graduated cum laude from Indiana University School of Law, Indianapolis in 1984. He has been a partner in the law firm of Rowe & Hamilton for 34 years. His practice is concentrated in auto, trucking accident litigation, and premises liability. He is currently on the Board of Directors of the Indiana Trial Lawyers Association, and has chaired and taught at numerous seminars locally and nationally concerning auto accident litigation and personal injury cases. Mr. Rowe was chair for the Indiana Trial Lawyers Annual Institute in November 2001. He is vice chair of the Republican Caucus for AAJ. He is the state delegate from Indiana for AAJ. He is a President’s Club member of AAJ and member of the American, Indiana, and Indianapolis Bar Associations. He is also a member of the Association of Plaintiff Interstate Trucking Lawyers. He is past chair of the Motor Vehicle Collision, Highway, and Premises Liability Section for the American Trial Lawyers Association. He is a member of the College of Fellows. He is tried over 50 jury trial cases. He has served on the Board of Directors of the Indiana Minority Health Coalition. He hosted a weekly radio program - “You and the Law” for over five years. He also hosted a television show called “Faith and the Law” that discussed legal issues of concern for Christians on Lesea Broadcasting. He is an author of two books “The Magnificent Goodness of God and How it Will Transform Your Life” and "The Heart: The Key to Everything in the Christian Life.” He is passionate about bringing justice to to people and helping to make the legal system better. He resides in Indianapolis with his wife Jexy and son Isaiah.

Q. My attorney thinks my case is waste of time? Should be realistic of outcome???
A: If there is no insurance, it becomes very difficult to collect a judgment. It sounds like the taxi company had very little if any assets to satisfy a judgment. A Motion for Proceedings Supplemental can be filed to see what assets the company might have to satisfy a judgment. If there are assets or money that the company has, the court could ordered them seized or attached to satisfy a judgment. The taxicab company could be a corporation with little or no assets and it could be hard to pierce the corporate veil to go after individual owners. Most attorneys will not take a case if there is no insurance to satisfy a judgment and they have to try to discover assets to satisfy a judgment. Clients get upset because nothing is being paid and often begin to blame the attorney. The company could have other creditors that are secured and if they file bankruptcy, it is likely as an unsecured creditor, the claim would be last in priority to be paid. The company could lose its license to operate without insurance, but some of these companies are self-insured and difficult to collect from.
Q. 2 years ago in Fl I was in a car accident. Wasn’t charged nor given a ticket. The other driver is now suing me.
A: If you had insurance at the time of the accident, turn the case over to your insurance carrier and they have a duty to defend the case. If you have been sued, they will hire an attorney to handle the defense of the case. You should have no out of pocket expenses for this defense. It was a little unclear from your email if the other party is just suing you for the property damage deductible or other damages for personal injury. Florida is a no-fault state so she would have to meet certain requirements regarding her injuries to file suit. Talk this matter over with your insurance carrier.
Q. We Were Fully Backed Out . I Put My Car In Drive And Before I Know It The Other Car Gassed It And Back Into Me.
A: Unfortunately police reports are not always accurate, and the police officer's don't always get all the facts right. Sometimes they have to make judgments right or wrong on what happened, and who they believe as stories often conflict. If you feel you received a ticket in error, you can fight it in court. Also you can turn in your property damage to the other driver's carrier. If they do not accept liability or place a percentage of fault to you, just turn it into your own carrier under your collision coverage, and let them fight to get your deductible back from the other insurance carrier. If you were injured in the accident, you need to seek out an experienced personal injury lawyer.
