Q. How is half ownership on a house used in bankruptcy?
A: If the equity exemption is 136,000 in Ohio, you should be fine unless you have more than 136,000 in equity in the house. Equity is value of house minus amounts owed. Contact an experienced bankruptcy lawyer to determine the next move!
Q. How can a person be indited whit out being chraged of the crime i never recived a citation or court for
A: If you’ve been indicted, you have been charged. They are supposed to notify you or send a letter but many times that fails to happen. Contact your lawyer and have him arrange to appear for arraignment and get a date. Nothing illegal about any of it.
Q. My wife had a car repossessed, ignored collector calls, and received a certified letters in the mail
A: Filing bankruptcy is probably the right thing for her to do. Yes. It will affect your house bc she is half owner of the asset and not responsible on the debt. You both need to sit down with an experienced bankruptcy lawyer who can evaluate the debt and the situation and help you make the right next move.
Q. I filed for bankruptcy in March I was arrested for a worthless check in April that’s inculded in my bankruptcy
A: The automatic stay does not operate to stay criminal prosecutions for criminal acts. While the stay would prevent the creditor with the worthless check from proceeding against you civilly, it does not stay criminal action for the crime of writing the worthless check. The worthless check debt most likely will not be discharged in bankruptcy although your lawyer properly included it in your bankruptcy. Hire a criminal defense attorney to resolve the bad check case. It likely can be dismissed if you make the check good.
Q. I filed chapter 7 bankruptcy and still have my car without reaffirmation?
A: Contact him about the situation snd be patient. Many times it is best not to reaffirm in a particular situation. As long as you continue paying for the car, they will not repo it. Sounds like his strategy may be to get you a clear title to the vehicle, but check in with him and talk it out.
Q. Chapter 13 modification hearing postponed ! Why did I have to call the Trustee's office to find this out ?
A: You need to seek an independent second opinion as to the status of your case before you make any decisions.
Q. I filed chapter 7 two weeks ago and now I have won the lottery. What happens now with my case?
A: File a motion to voluntarily dismiss your petition, pay your creditors off, then enjoy the rest of your winnings.
Q. Need a copy of full custody of her chidren
A: Go to the clerks office of the court that awarded her custody and request a copy of the custody Award Order.
Q. Filed Chapter 13, but the case is getting stranger and stranger ! I think my lawyer lied to me !
A: Go to the court house and get a complete copy of your file. Then have another lawyer evaluate the case independently and see if your suspicions are correct or not. May be all easily explained and legit, or Maybe not. File review will tell.
