Q. How do I get my parents (Calif) be declared legally incompetent? A court ordered evaluation?

A: It is likely that you will need to have yourself or one of your siblings appointed conservator of the person and of the estate. This will permit the conservator to make both medical and financial choices for your parents. The probate court will decide whether to grant the petition to appoint a conservator (typically after a rather short proceeding). Q. I am the defendant in a civil case in California which I am not contesting. Do I have to sit for a deposition?

A: As you indicated, there is a potential that you could incriminate yourself in answering questions in your depo. I suggest that you contact a lawyer, as the lawyer might be able to have the depo subpoena quashed or, if the depo does go forward, object to certain questions and instruct you not answer.
