Steven R. Smith was born in Queens, New York and has lived in Queens County, Kings County, Nassau County and Suffolk County. After receiving an undergraduate and masters degree in Psychology, he went on to obtain a law degree from Prestigious "St. John's University School of Law." He has given back to students there by serving as a "mock trial" Judge and hired interns to learn about the practicalities of law.

Q. Can a personal injury case in supreme court be heard after 30 yrs? I have a 1,000,000 suite against the city of NY
A: Well first of all, go on the court website and make sure that your case is marked ‘active’ and not ‘disposed’ which would be a problem. If it’s ‘disposed’ it means the case is closed and then someone would have to contact the court to get it re-opened. Unless of course, there was a dismissal or settlement which are generally the reasons a case would be ‘disposed.’ Secondly, you are absolutely entitled to your file and should insist on it. Finally, you are not obligated to use any particular attorney and once you get the file you can have it reviewed by an attorney of your Choice to then see who you want to use.
Q. In regard of a car accident
A: Unfortunately, you are 1 1/2 years late for getting the assistance you need if you are in NY. You really needed an attorney at the outset. I can only comment on New York Law, so if this is another state this response might not apply. In NY, you would not use your primary health insurance for medical payments and treatment resulting from a motor vehicle accident. In NY you would file for No-Fault benefits within 30 days of the accident and the insurer for the vehicle you occupied would pay all of your medical bills for a period of time, up to 3 years. They would also pay 80% of your lost earnings up to $2,000 per month (or more depending on the policy endorsement). While insurance companies for the other vehicle involved in the accident might initially tell you that they will take care of everything, they generally end up taking the side of their insured and so they often change their position. At this point, if you want to get compensated for the days out of work, and assuming that you never applied for No-Fault benefits, you might have to turn to litigation against the other party, which may be tricky and costly, depending upon whether you also have a viable personal injury claim. You should consult a personal injury attorney in NY for the best advice particular to your case.
Q. being sued by someone claiming personal injury from my car in 2018. He went through my insurance. Now he’s suing me
A: Claims are usually started with your insurance company. Perhaps the property damage claim was settled with your insurance company but apparently the bodily injury claim was not able to be settled. This generally occurs when the the offer made by your insurance company is significantly less than the attorney for the claimant believes the case is worth. But that is why YOU have insurance. Turn the Summons & Complaint over to your insurance company, ask them to represent you, and they will assign an attorney to represent you at no cost to you. They will defend your interests and if a payment is made to settle the case, your Insurance company will pay up to the liability policy limit. Only in the rare case of a trial and a verdict would you be asked to pay more than your policy limit. This is indeed a rare occurrence. For now, and for the most part turning the matter over to your insurance company will be the best step. Best wishes
