- Joel H. Schwartz, P.C.'s Managing Partner Steven Schwartz met with the Japanese B2B consulting firm Funai Soken at the Prudential Center in Boston in order to share some insight into American personal injury law. Schwartz spoke for two hours to approximately 20 upper-level management employees, lawyers and consultants as a part of Funai Soken's STUDY Tour, which visited great companies to work for throughout the East Coast. Schwartz's presentation detailed the inner workings of a personal injury law firm, how a personal injury claim process works and how Joel H. Schwartz, P.C. specifically became so successful in the Boston area. He also advised the Japanese firm how to keep customers happy and how to attract new customers to their firm. The firm was very thankful for the advice, and after the meeting, Funai Soken's Kyohei Deguchi sent Schwartz a letter of appreciation and extended a reciprocal invitation to visit the firm's office in Japan.

- A: Lawyers are no different from plumbers or electricians. If you are not happy with the services you are getting, you can always switch. It is important to have confidence in your attorney and that he or she is working in your best interests and satisfying your concerns. Communication is probably the biggest complaint I hear when it comes to someone's attorney. I suggest you insist on a meeting to address your frustrations. If you don't get satisfactory answers, you may think about making a switch. Remember, you only have one shot at this, so you want to make sure it is being handled by the appropriate law firm. - Q. My daughter was clipped by a plow on Saturday night and is traumatized by the incident. Do I have a case?
- A: So sorry to hear about your daughter. My gut tells me that this may not be worth pursuing, especially if your daughter's injuries are minor. It sounds like the police report is not helping the situation, noting your daughter's dark clothing. The other issue not mentioned is that you stated your daughter was walking WITH traffic which is not what she should be doing. In MA, as a pedestrian, the law says you are to walk against traffic. My guess is the insurance company will deny the claim, and then you are faced with the decision of filing a lawsuit which will be a 2 year process and expensive. - Q. A car two in front of me stopped suddenly and then turned -- the car behind me hit me -- who is at fault here?
- A: You did what you were supposed to do. You were able to stop in an emergency situation and you are supposed to be ready for emergencies like this that lie in front of you. The car behind you did not. He or she was arguably driving too close to you and unable to stop. The car behind would be responsible for this accident.
