Biography

Stephen K. Brooks practices at the Brooks Law Group with offices in Tampa, Lakeland, and Winter Haven, Florida. He can be reached at steve@brookslawgroup.com or 1-888-We-Mean-It. Steve received his B.A. Degree from Stetson University and his law degree from Stetson University College of Law. Steve also had the opportunity to study at Oxford University through an arrangement with Stetson University College of Law. He then joined a six-member law firm. The diverse experience he gained there has been invaluable to his own firm. It is the basis of a wide pool of practical knowledge and personal contacts from which he continues to draw. Steve devotes all of his current practice to “people” problems, personal injury, wrongful death, and social security disability. His widespread success in these areas is quickly creating a reputation of a force to be reckoned with. Yet he is easy to talk to and his sincerity quickly turns clients into friends. One of the reasons for Steve’s success is immediately apparent. He is the rare combination of a “can-do” individual with a no-nonsense approach to getting things done. He cares about the people he represents… and it shows. Raised in the Winter Haven area, Steve maintains his close ties in the community. He currently serves on the Board of Directors of Tri-County Human Services, Inc. (http://www.tchsonline.com/home/). He has also served on the Board of Directors of Meals on Wheels. He is a member in the local Chamber of Commerce and on the professional side, is a member of The Florida Bar, an Eagle member of The Florida Justice Association and The Polk County Trial Lawyers Association. Steve is also a member of the Association of Plaintiff Interstate Trucking Lawyers of America. Steve has received the following honors and recognition: Selected as one of the Top 100 trial lawyers in the State of Florida by the National Trial Lawyers Association in 2009, 2010, 2011, 2012, 2013 & 2014. 3 Questions Answered
Q. Hello, I am a 24 year old Florida Resident. My questions relates to a concealed weapon permit and purchase of firearms.
A: Most likely the answer is yes, it will show up. License to carry concealed weapon or firearm: (1) The Department of Agriculture and Consumer Services is authorized to issue licenses to carry concealed weapons or concealed firearms to persons qualified as provided in this section. Each such license must bear a color photograph of the licensee. For the purposes of this section, concealed weapons or concealed firearms are defined as a handgun, electronic weapon or device, tear gas gun, knife, or billie, but the term does not include a machine gun as defined in s. 790.001 (9). Such licenses shall be valid throughout the state for a period of 7 years from the date of issuance. Any person in compliance with the terms of such license may carry a concealed weapon or concealed firearm notwithstanding the provisions of s. 790.01. The licensee must carry the license, together with valid identification, at all times in which the licensee is in actual possession of a concealed weapon or firearm and must display both the license and proper identification upon demand by a law enforcement officer. Violations of the provisions of this subsection shall constitute a noncriminal violation with a penalty of $25, payable to the clerk of the court. The Department of Agriculture and Consumer Services shall issue a license if the applicant: (i) Has not been adjudicated an incapacitated person under s. 744.331, or similar laws of any other state, unless 5 years have elapsed since the applicant’s restoration to capacity by court order (j) Has not been committed to a mental institution under chapter 394, or similar laws of any other state, unless the applicant produces a certificate from a licensed psychiatrist that he or she has not suffered from disability for at least 5 years prior to the date of submission of the application.
Q. I was served sharp plastic pieces in a frappe from McDonald’s nearly died choking on it. Went to the ER
A: In most cases you do need an attorney. The insurance companies are billion dollar businesses staffed with attorneys and adjusters who do this everyday. In order to level the playing field you need an attorney. Often the insurance company for the person who caused the injury will try to settle with you before you have an opportunity to retain an attorney. The reason for this is that the insurance company knows it can probably settle the case for less money if you do not have a lawyer. We will investigate your case and obtain the necessary witness statements, documents, photographs, and other materials to protect your rights.
Q. Can and opposing attorney bring up reasons not listed in a petition for custody hearing?
A: Yes.
