Biography
My name is Birk Baumgartner, and I am the principal at Baumgartner Law, LLC. I graduated from Southern Methodist University Dedman School of Law, and have been a litigator ever since. I am the fourth attorney in my family, but unlike my family members, I declined a job at a big law firm. Instead, I decided to dedicate my practice to a limited number of cases, with focused and individualized care and the freedom to take only those cases that I believe are just. I am dedicated to practicing law the old-fashioned way - through real personal relationships with my clients.

- Q. Whats the process in sueing an attorney for misconduct in the state of Colorado?
- A: This may be a professional misconduct referral. There is not enough information here to discern whether this is a legal malpractice issue, or a breach of professional ethics. If this is an ethics issue, then you should make a complaint to the Office of Attorney Regulation COunsel. If this is an issue that caused you damages, you should contact an attorney practicing legal malpractice for a consultation. But again, more information is needed.
- Q. my sister still lives with our highly abusive mother. how can I legally get her out of there.
- A: I am very sorry you are going through this. This is definitely a complicated family law question. However, if you suspect abuse of your sister, then you should call the Department of Human Services, Child Protection Division, and possibly the police. The answer to how you get her out of there likely depends on the results of those investigations, as well as your sisters age, and many other factors. But the first step should be reporting abuse.
