Q. I just have a question. Im currently going through a divorce my first court date is next month.
A: Your situation is not clear. It appears that you are representing yourself in court. Q. How do I get custody of my son when he is in Florida. And I live in new york he won't let me see him.

Q. Ex husband has placement, joint custody, and is married to a felon.

Q. Will I be able to have my son fully even if I am not marry and decide to not live with the baby’s dad anymore?
A: How can your parents look after the son while they are in Texas, unless you are planning to Texas with the child, which might not be possible so unless they decide to come to New York and help look after the child or are you saying they are willing to help you financially to take care of the child. To have the child fully, you will have to demonstrate that you are a better parent than the other one. This can be done by showing your degrees, employment, stable home environment and etc etc. Also a competent and aggressive attorney that will fight tooth and nail to win full custody. Full custody can become very expensive around $20,000 - $40,000 over 2-3 years. Unless the other parent is the worst nightmare. Then you can expect $3,000 - $7,000 over 12-24 months. Q. Paid child support 1 1/2 years before petition was filed, judge mentioned a credit for that at preliminary hearing. NYS
A: The credit the judge is referring to will cover child support. However, for Alimony you need to work with a lawyer to contest it, otherwise most likely if she is determined to seek it, she will get it. Q. Am I obligated to send my baby to see her father? What are my rights here?
A: He is not on the birth certificate, so technically he has to prove that he is the father through court in order to obtain visitation and custody. Unless you acknowledge the fact that he is the father and then you will be liable to grant him his parental rights. So, for now, you don't have to grant him visitation or custody unless you feel to do so. If he wants to be a part of your life than let him go to court, file for visitation, paternity, and custody. At that point you can argue a case with the help of a good lawyer, using all that you have mentioned here to give him supervised visitation. This might get crazy though before he goes to court.
