Q. Do I have a dental malpractice case if my dentist was negligent and left me with no teeth since last summer?
A: As with everything, it depends. It sounds like you have been through a terrible ordeal. You likely could have a case - these types of cases require preliminary expert reports, so to get to the case, you would need a dental surgery expert to review the records and opine on what went wrong and why. Regardless, I think you should contact an experienced Personal Injury attorney to discuss further.
Q. I purchased property in Arizona paid cash have the receipt but now she refuses to quit deed it.
A: The details of this case are necessary to provide specific answers. However, generally, the chain of title should be recorded with the County's Recorder's Office. In this situation - when the seller refuses to transfer title - you typically would file an action in the Superior Court to "Quiet Title." This means you are asking the Court to look at the facts - including your payment of cash - to determine who has the rights and interests in the Real Property. If you have a contract for the transfer of title, you may also sue for breach of contract or, in the alternative, unjust enrichment. You may also - depending on the particular facts - potentially have a fraud or negligent misrepresentation case. I hope this helps.
Q. so if a case is 12k and the attorney wins under ars 12-341.01 what will the award possibly be? if the case was lost.
A: Unfortunately, there are no easy answers here. I assume you are stating that the opposing party won. ARS 12-341.01 applies to attorneys fees in Breach of Contract cases. If your case was a breach of contract case, you lost, and the opposing party is ordered as the prevailing party, then the opposing party may file an application for attorneys fees and costs. The statute is clear that only reasonable fees and costs may be awarded. The opposing party has the burden to show the Court that their fees meet this requirement. Typically, the application is required to apply the elements delineated by the Schweiger v. China Doll Restaurant case. This is colloquially referred to as a "China Doll Affidavit" and requires the application to list all time entries and the value of each. If the application includes "Block Billing," those line items may be stricken from the application. Block Billing is the practice of including multiple activities in one encompassing time entry. I'm sorry it is not black and white, but I hope this helps you.
