- Q. Can plaintiff in Pro Per request monetary sanctions in Motion to Compel further discovery responses?
- A: Yes. In California you may request monetary sanctions in a Motion to Compel Discovery Responses or to Compel Further Responses. However, you may be limited in the damages you can claim since you are not an attorney and cannot claim the reasonable value of your attorneys' fees. However, you can claim reasonable expenses incurred due to the unjust delay to provide responses or complete responses.
- Q. my ear popped 2 years ago due to loud noise while working for amazon
- A: If Amazon is your employer and responsible for causing a dangerously loud noise that damaged your hearing, your remedy is exclusively through the workers' compensation system.
However, if some entity other than your employer or your co-employees caused the dangerously loud noise, you might be able to bring a personal injury action against them. However, be aware that your deadline to do so is two years from the incident.
- Q. In CA, in a car accident involving injuries- settlement, is it standard for a physical therapist to get 33%?
- A: Physical therapists and doctors cannot charge a percentage of your recovery. They are often paid by the hour and their rates must be reasonable for the services they provided as judged by a community standard (e.g. bills in SF and LA are going to be higher than Barstow for the same service).
Now, if they bills are billed hourly and just coincidentally are 33.33% of the total recovery that is legal so long as the services were reasonable as well as the individual billings.
