160 Questions Answered
- Q. Can Maryland's State Highway Administration lawfully bill citizens for damage repair? Ex: guard rail.
- A: Not guilty does not necessarily mean you were not responsible. So this question cannot be answered without knowing all of the facts. But the not guilty does not necessarily release your potential liability
- Q. I got seriously injured playing in an adult rec sports league. I did not sign a waiver. The turf is old. Can I sue?
- A: You may have grounds to file a lawsuit against the organizers of the adult rec sports league. If the turf is old and its condition may have been the reason for your injury, the organizers may be liable for negligence. The fact that you were not asked to sign a waiver before participating in the league may strengthen your case.
But can you find a lawyer to bring that claim and medical experts to link your injury to the turf? It is possible. But I think both will be a challenge in most cases like this. The answer depends on the answer to a number of questions:
What were the specific circumstances surrounding your injury? How exactly was the turf the cause?
Where were you playing, what ... Read More
- Q. Am I negligent?
- A: I understand your concern. I think your chances of real liability here approach zero. First, your response was reasonable. The student's behavior and lack of visible symptoms could have led you to believe that the injury was not severe. Second, it is extremely unlikely that treating these injuries earlier would have made a difference. It is the rare simple fracture - which is what this sound like - would have a better outcome with just slightly earlier treatment.
