- Q. Is a wrongful death case the same as a murder case?
- A: No, a wrongful death case is not the same as a murder case. A wrongful death case is a civil suit seeking damages (money) and is typically brought by a family member of the person who lost their life. A wrongful death case does not carry criminal penalties with it. On the other hand, a murder case is brought by the state of Texas and involves potential criminal penalties.
The types of proof required in the cases are also very different. In a wrongful death case, the plaintiff must prove the defendants fault by a preponderance of the evidence. In a murder case, the state must prove guilt beyond a reasonable doubt (a much tougher standard).
- Q. My son was in an accident that has totaled out his car. The other insurance co does not want to take full responsibility
- A: I understand your situation may be worrisome, but it occurs commonly. Insurance companies will often dispute liability because it can save them money. If I were you, I would contact an attorney in your area to handle your claim. Make sure to find someone with experience, who you feel comfortable with, and who will file suit (if necessary). Once you find a lawyer to fight for you, leave the worrying to him or her. All the best!
- Q. My dad had filed a personal injury lawsuit but then died due to the injuries he sustained from the same accident.
- A: I'm sorry to hear about your loss. To address your question, claims are often brought on behalf of family members who have passed on. Texas law allows an estate, legal representative, or any heirs to bring a "survival action", or a lawsuit that would have been brought had the person lived.
If your dad had already filed a lawsuit through an attorney, you should not hesitate speak to the attorney about representing you/your family in the lawsuit.
I hope this helps. All the best to you and yours.
