Q. I was convicted of a DUI-drug A.R.S. 28-1381 (A)(1) in the state of Arizona. Will I be required to have an interlock?
A: Yes, pursuant to A.R.S. 28-1381(I)(6) requires the court to report the conviction to MVD and the department will send you a letter requiring you to install the ignition interlock for 12 months pursuant to A.R.S. 28-3319 and show them proof of it. You will also be required to take an -hour traffic survival school pursuant to A.R.S. 28-3306.
Q. In Arizona, is a 'Commissioner" the same as a Judge or Magistrate for purpose of authorizing a Search Warrant? '
A: Yes, a commissioner, judge and a magistrate may all authorize search warrants.
Q. Victim of a drunk driver that damaged property exceeding $30,000 in repairs. Need a lawyer who can file civil suits.
A: First you need to search for other possible insurance policies on which to make claims, but if there are no other policies available, besides the one you have exhausted, then you need to do an asset search on the liable party to see if it will be worth the return on your investment to file a lawsuit against them. Check your own insurance coverage.
Q. I’m representing myself in a criminal case, how do I reschedule the court date to prepare?
A: If you are facing jail time and cannot afford to hire private counsel, the court WILL appoint you a lawyer. The State needs to give you all the evidence they have against you, police reports, videos, photos, etc. so that you can decide whether you want to reach a non-trial disposition or go forward to trial.
Q. I'm 18 years old and my boyfriend is 26 years old , can we get married ?
A: Why would you not be able to marry him? Legally you are an adult and are allowed to marry whoever the law will allow you to marry, so unless he is a first-cousin, or other close relative, you can marry him.
