Biography

I have been practicing law since 1979, including 16 years as a district attorney. I am a former judge, and I also handled many military trials during my years of service with the Navy JAG Corps. I am a member of the National Association of Criminal Defense Lawyers (NACDL) and the Colorado Criminal Defense Bar.

Throughout my criminal defense law practice, I have successfully handled thousands of criminal law cases. Q. In Colorado is an officer allowed to enter your vehicle after it's been locked after you've been taken to police station
A: Not without probable cause and some exigent circumstance, a search warrant, or consent.
Q. Can a person be charged with “eluding” if the officer never turned on his sirens, lights, or used any other method?
A: The answer is no. The law says "knows or reasonably should know that he or she is being pursued" is the felony statutory language. "...Who has received a visual or audible signal such as a red light or a siren from a police officer driving a marked vehicle showing the same to be an official police, sheriff, or Colorado state patrol car directing the operator to bring the operator’s vehicle to a stop, and who willfully increases his or her speed or extinguishes his or her lights in an attempt to elude such police officer, or willfully attempts in any other manner to elude the police officer, or does elude such police officer commits a class 2 misdemeanor traffic offense" is the traffic offense of eluding.
Q. Can I get a case closed by providing the DA info on a high priority cold case?
A: No DA will make a promise based on the vague information you are willing to share. You need to have a criminal defense attorney try to negotiate this for you. It may not be possible.
