American Airlines v. United Stateslead counsel for American Airlines in a tax refund action. Settled for one hundred cents on the dollar plus interest on American’s principal refund claim following a successful appeal to the United States Court of Appeals for the Federal Circuit. Butler v. Sterling Jewelers, Inc.lead trial counsel for a large retail jewelry chain in a putative class action in the Northern District of Ohio alleging misconduct in the marketing of credit insurance. Defeated class certification and obtained dismissal of all but a single Truth in Lending Act claim (total judgment of $149.24), which was affirmed by the Sixth Circuit on the plaintiffs’ appeal. Daiwa Special Asset Corporation v. Desnicklead trial counsel in Southern District of New York litigation for secured lender to a Chicago hospital to enforce owner’s personal guarantee. Obtained summary judgment on all claims for the full amount sought. The defendant abandoned his appeal and settled for paying 100% of the judgment amount plus a portion of Daiwa’s attorneys’ fees and costs. Ever Cabrera v. Dan Butlertrial counsel in pro bono civil rights action for individual subjected to police brutality filed in the Eastern District of Virginia. Favorably settled in the middle of discovery. Government of Canada v. United Stateslead litigator in conjunction with Extraordinary Challenge Committee proceeding under United States/Canada Free Trade Agreement concerning massive countervailing duties imposed upon softwood lumber exports from Canada. Obtained complete victory for the Government of Canada, including the return of some $800 million in countervailing duty deposits. Hauben v. Manchester Partners LPlead trial counsel for real estate developer in dispute with limited partner investors. Case favorably settled during discovery following successful appeal to the Third Circuit. Hauben v. Manchester Partners LP. In Re Domestic Air Transportation Antitrust Litigationtrial counsel for American Airlines in defense of class actions consolidated in Atlanta alleging fixing of airline ticket prices. The case was favorably settled during the pendency of an interlocutory appeal to the Eleventh Circuit challenging the District Court’s refusal to order individual notice to millions of identifiable airline ticket purchasers. In Re: Greater Southeast Community Hospital Bankruptcylead trial counsel for Daiwa Securities of America, a secured creditor of a District of Columbia hospital, in litigation against bondholders claiming to be a senior secured creditors. Obtained recovery of one hundred cents on the dollar for the client following victory at trial. Jesse v. Avon Products, Inc.lead trial counsel for Avon Products in Eastern District of Virginia “rocket docket” suit brought by former independent contractors of Avon seeking redress for termination of a lucrative recruiting incentive program. Obtained summary judgment for the defense on all claims. Marcus Allen et al. v. National Football League Players Associationlead trial counsel for the NFL Players Association in suit brought by Marcus Allen and Ronnie Lott, who claimed breach of an alleged oral partnership agreement by the players union. Case was favorably settled on the eve of the hearing on the NFLPA’s summary judgment motion. Ornelas v. United Statesappointed by the United States Supreme Court to brief and argue as amicus curiae in support of the judgment in a criminal case, where the government had agreed with the petitioner that the Seventh Circuit had utilized an inappropriate standard of appellate review of the District Court’s finding of probable cause. The Chief Justice’s majority opinion acknowledged that Mr. Isakoff had “well fulfilled his assigned responsibility". Oxford Capital Corporation v. GECClead trial counsel for GECC in $15 million suit in federal court in Baltimore for breach of an alleged contract to sell accounts receivable. Plaintiff voluntarily dismissed the lawsuit in its entirety with prejudice for zero recovery in the middle of discovery. Williamson Oil Co., Inc. v. Philip Morris et al.lead trial counsel for Lorillard Tobacco Company in cluster of related antitrust class actions alleging conspiracy to fix prices among cigarette manufacturers consolidated in Atlanta. Obtained summary judgment for the defense, resulting in complete dismissal of all claims.
