Born and raised in Moses Lake, WA Grant County.
Attended BYU Provo and graduated Dec 1988
Played college football at BYU from '84-'86
Attended and Graduated Gonzaga University Law School May 1992

I am married to Lori Dawn (Irick) Earl since Dec 1991. We have 5 children, 4 girls and 1 son. I have been a practicing attorney here in Moses Lake, Grant County since July 1992.

Q. Can a conviction be appealed in Washington for an accidental shooting incident involving intoxication?
A: The real answer here is no, by accepting the deal and pleading guilty you gave up your rights to confront your accusers and question them. All your appeal rights so that is just the way it is. You should have fought the case and gone to trial and then if you lost your appeal rights would still be in tact.

You were not threatened with 8 years of prison, you were informed that that was what could happen if found guilty at trial. You decided to accept the deal for a number of reasons and I can't state with the limited amount of facts here in your questions whether you made a good, great or bad decision HOWEVER, you did make the decision and now it is what it is.

There is a way to withdraw your plea of guilty to a case BUT IT IS VERY DIFFICULT TO DO SO, ALMOST IMPOSSIBLE AND SO i would say that your options are none. ... Read More
Q. Can I be charged with criminal trespassing after living on a property for 20 years?
A: This issue is rooted in Landlord/tenant law so you need to consult with an attorney that handle that type of cases because you may have an argument there. Obviously you don't have a deed or ownership because of purchase, but through being there with the knowledge of the owner you may have some legal rights and those will only be understood through that type of law. Then you will have to explain it to the prosecutor's office IF you have a leg to stand on through Landlord/Tenant.
Q. Im not sure what to do, I was involved in a $2k shoplifting incident that resulted in Macy's security breaking my tooth.
A: I only handle criminal offenses, I DO NOT sue people or do civil lawsuits so IF you have a claim against the city, police force etc. I DO NOT KNOW and wouldn't be able to help you. IF you get charged with a crime is where I would come in but I live in Moses Lake WA and that is a long way from here you are and I assume you would hire an attorney from your area for cost reasons.
