- Q. Can I stop another restaurant from using my trademark in a different state?
- A: Possibly. It is advised that you speak to counsel.
However, if the "infringer" is using a similar name prior to your federal registration, then they might be protected by common-law trademark rights. If you need more information, then I would recommend reading "Burger King of Florida, Inc. V. Hoots" or speak to legal counsel.
- Q. Can I operate locally as "Kadosh" and later trademark it?
- A: Initially, I would advise seeking trademark counsel to fully advise you on your situation.
There are multiple factors that are at play here. First is your name "Kadosh" which is Hebrew for "holy" or "sacred". Examiners might view this word as descriptive of the type of services you provide and deny protection. Second is whether the small Florida company has a presence throughout the US or local. Third is whether your goods/services are similar to the Florida Company.
It is advised you speak to legal counsel to fully review your rights.
- Q. Can I trademark a unique name for my software already used by retailers?
- A: It depends on a lot of factors. I would advise obtaining proper legal counsel to perform a trademark search for you. Even though it might be retailers, it is common for the Trademark office to deny protection for "similar" types of goods and services, i.e., a dentist who uses a specific name might be prevented protection because an insurance company uses a similar mark.
To properly protect yourself and prevent yourself from stepping into any legal pitfalls, it is advised to obtain legal counsel.
