Summary

When I first received my drivers license, I was pulled over and searched without legal cause. This violation of my rights has fueled my passion to fight for persons accused of crimes they didn't commit or defend cases where law enforcement has overstepped their legal authority. This drive continues to motivate me to be prepared in court, fight for my clients, and remain on top of the educational components of my field. This excellence is reflected by the Continuing Education of the Bar (CEB) selection to have me co-author a chapter on chemical test evidence in the book Scientific Evidence in California Criminal Cases.

Q. My son is 28, he got a dui in August 0f 2018 in Sacramento, CA. He paid all his fines and finished his dui classes.
A: Yes, as long as it meets the terms of his restrictions/limitations, he may still have an Ignition Interlock Device requirement and for sure an SR22 requirement, one (or both) may need to be in place for him to drive any car.
Q. My brother made an illegal u-turn and chp pulled him over.i was not inside the vehicle but was arrested for dui
A: I'm sure there's a question here, but I can't figure it out. If you're wondering about defending the case you should discuss the facts with a local DUI defense attorney, there are several good ones in Santa Clara County. The prosecutor has to put you behind the wheel of the car, since you weren't actually driving or seated in the car he/she will have to do it with circumstantial evidence which can be difficult to use to convince judges and jurors.
Q. Now that it legal to smoke weed for recreational purposes
A: Perhaps another respondent will have a different opinon, my understanding of the law is that smoking in public places is limited to the laws surrounding the use of cigarettes or other things people smoke. The laws surrounding smoking are both locally enacted as well statewide, probably you can't legally smoke in a park or on the beach. If you are stopped for a moving violation and paraphernalia used for smoking pot is found, you might find yourself being investigated for driving under the influence.
Q. What are sentencing possibilities for this situation?
A: This is a complicated situation, if he is on probation for any previous DUI case the driving with a measurable amount of alcohol and driving with a suspended license are probation violations. Additionally, being .08 or above and driving on a suspended license are misdemeanor offenses in their own right and in this case the DUI might be a felony if it is #4 in 10 years or he was convicted of a felony DUI in the past 10 years. In all, he is in very serious trouble and needs to consult with a local DUI defense attorney.
Q. Can I get a pro bono lawyer on a dui charge??
A: The pro-bono attorney you are asking about is the Public Defender and, yes, they are always very busy but that doesn't mean they aren't conscientious about the work they do for their clients.
Q. 3 priors, sentenced ,& now blew 0.08. wondering what he looking at for sentencing WithNo tolerance law,
A: If you are looking at a 4th offense in 10 years you are likely looking at a felony DUI which is significantly more serious, it also sounds like you are still on probation from one (or, more) of the earlier offences. Depending on the facts of your case you might be looking at over a year in jail. You really should contact a local DUI defense attorney to discuss the facts of your case, possible defenses and likely outcomes.
Q. Is an accident itself probable cause to administer a breathalyzer? When officer arrived on the scene after it happened?
A: No, but if the officer thinks alcohol was involved in your driving and accident he/she is permitted to investigate the crime and that investigation can include a breath test in the field.
Q. 2009 i got a dui and 10 years later i wanna take care of my classes so what steps do i need to do first or take
A: Call Mandatory Actions 1.916.657.6525, they can tell you what you need to do to get reinstated. You probably will need DUI School, SR22 insurance and pay some fees. You might check with the court, if a proof of completion for the DUI program wasn't filed you might have a warrant.
Q. I got a DUI in Arizona and I live in California. I am trying to get a restricted license to drive in California.
A: Right, you probably will have to enroll in the CA DUI program, call Mandatory Actions in Sacramento they call tell you what needs to be done, 1.916.657.6525
