Q. My mom is in a nursing home and my question is if there is a nurse working there that I would prefer not to care for mom
A: You need to address your concerns with the nursing supervisor and director of the home. However, if your mother is receiving her medicine as prescribed, it does not appear at this point there is a valid claim for abuse or negligence.
Q. I have a mmalpractice case in Indiana Pro Se and one of the defendants does not have to participate in the review panel?
A: Your question appears incomplete. More information is needed to provide you an answer. If you are asking if a defendant doctor or provider is not required to participate in the medical review panel process, more information needs to be provided to give an answer to you. If the provider is not covered by the Medical Malpractice Act, the provider is not protected by the damages caps in the Act and subject to a lawsuit without first going through the panel process. Maybe if you provide some more information, an answer can be given.
Q. Who's to blame, if a person takes another to dinner, which gets hit by champagne cork by the waiter?Waiter or restaurant
A: Both would have some degree of negligence. The restaurant would have potential liability as the employer and responsible for actions of employees.
