Michael Fayard
Former Prosecutor in Florida and Hawaii. The Trial Lawyer You Can Count On!
I am a former prosecutor in both Sarasota, Florida and Maui, Hawaii. I have prosecuted and defended some of the most serious crimes.
My focus is provided the highest caliber legal representation to all of my clients in contested legal matters. Your right to a trial by jury is a fundamental right if you have been injured in an accident, accused of a crime or suffered a wrong at the result of someone else's behavior. I differentiate my practice in that I routinely try cases before juries and courts.
I am authorized to practice in all state and federal courts for Florida, Kentucky, Colorado, and Hawaii. I am also regularly admitted to practice in other courts around the country in order to represent my clients. I also act as trial counsel and litigation support for other firms and lawyers throughout the country.
My jury trial experience includes successful representation for client in severe personal injury cases, including car accidents, Jones Act Maritime Cases, Truck Accidents, and general personal injuries; complex civil cases, including business litigation matters; family law cases, including divorce, custody, support and alimony; bankruptcies, both personal (Chapters 7 & 13), Business Reorganizations (Chapter 11), and Adversary Proceedings; and criminal cases, including serious felonies and sex crimes.
I have a proven history of seven figure verdicts and settlements for my injured clients, and excellent results for my criminal defense clients.

- Q. Do I need a lawyer with me if the police want to question me about a crime
- A: Absolutely. If you are suspected of any crime, then it is always better to have counsel.
First, you are under no obligation to speak with the police. If they want to talk with you about a crime, chances are they don’t have enough evidence to charge you. Yet. Because if they did have enough evidence, then they would get a warrant and arrest you.
Second, you can rarely, if ever, talk yourself out of an arrest, but you can certainly talk yourself into one!
- Q. What would be the charge for getting a Emergency order citation
- A: 127A-29 violations are generally misdemeanors with the maximum punishment of a $5000 fine and a year in jail. These charges also have the right to a jury trial. See https://www.fayard-law.com/maui-criminal-defense/maui-127a-29/ for more info
- Q. What is the code to a lawyer by entering the number associated with that particular attorney called
- A: Do you mean bar number? If so, you can find that on the state bar association’s website (Hawaii is HSBA.org). And then you can search by attorney name. Other states allow searching by different parameters.
