Israeli supreme court Landmark Decision on Child Support

On July 19, 2017, Maya Rotenberg set what is considered to be the most important family law legal precedent of the last few years in Israel’s Supreme Court ( Fam. Ap. 919/15 Anonymous v. Anonymous).

The highest court in Israel in an extended panel of seven justices accepted unanimously claim for equal responsibility between Jewish parents for child support of children age 6 to 15 years who were under the shared custody. This rejected the long history of Jewish ancient laws of halacha applying for child support payments mainly with the father.

On this issue, Adv. Maya Rotenberg claimed on behalf of the divorced father, the Supreme Court held that both parents were equally responsible for child support and that their relative child support payments should be calculated by taking into account both parents relative economic ability including income from work and other resources, child's needs, and visitation arrangements.

This important ruling affects almost every divorce case in the family or rabbinical courts in Israel today. The precedents effectively set a new child support rule and equality between parents.
