With more than 20 years of litigation experience, we've handled more than 200 cases in the federal courts of New York and more than 100 cases in New York state courts. We've tried cases in Westchester County, New York County, Kings County, Queens County, and Nassau County. We've tried cases involving civil rights to contract rights, from personal injury to property disputes, from lien law to employment law. On the plaintiff's side we've been in the Top Verdicts in New York Verdict Search. On the defendant's side we once had a jury award only $1 against our client. We've been in the New York Times, the Wall Street Journal, the Village Voice, and Forbes. We've written articles for the New York Law Journal, the New York State Bar, and several New York Law Reviews. We've won awards for our writing skills, received written acknowledgements from a federal judge for our trial performance ("outstanding"), and a slew of compliments from the people we've helped (see our website). We have three degrees, including a Masters of Law. We're even an Administrative Law Judge for a State agency. We enjoy our jobs and we love our clients. We are one of Westchester's most sought after lawyers.

2 Questions Answered

Q. is it right for me to be charged as the vendor for something that the customer inputted online incorrectly?
A: Greetings. Are you a retail establishment? If so, New York has codified general business rules concerning refunds. For example, a retail merchant that has a refund policy must provide notice of the policy to its customers and then live up to whatever promises are made in the policy. If it's a "no refund" policy, for example, then the merchant would have to live up to just that: no refund. If it is a "refund if not used" policy, then the merchant would have to live up to only that: refund if the items have not been used. Etc. And of course, contract law would also likely apply (whether or not you are a retail establishment), in particular the law of mistake, which may require the incorrect order to be vacated. Q. We require to write on an envelope tender:“tender no... st’” and we wrote street instead
A: Greetings. We do not have sufficient information to provide you with a reliable answer. From what we can tell, you made a typo on an important document and want to know if you can be fired for it. The simple answer is yes. In NY, you may be fired at will unless you have a contract that says you can't (e.g., "for cause only") or you are protected under an employment statute (e.g., NYSHRL). There may be other protections as well. In your matter, we do not have sufficient information to provide you with any further opinion. We hope this answer helps you nevertheless. You must speak to an attorney immediately for a more thorough opinion.
