I was born and raised in NJ. graduating Emory Law School, Atlanta Georgia in 1978. I was a Governor's Intern assigned to the Union County Prosecutor in 1977 while in Law School and became an Assistant Prosecutor there,1980-83. I was assigned to the Appellate Section, Juvenile Section, Assignment Judge's Trial Team, Elizabeth Project Trial Team, and the Narcotic Strike Force, handling over 300 files and trying 28 case to verdict. I learned how the police and prosecutors think and act.

I have only practiced criminal defense since leaving the Prosecutor's Office, first as a partner at Nassberg & Cheser 1983-1988, and then a solo practitioner from 1988- to the present, altogether 35 years. The N.J.Supreme Court designated me a Certified Criminal Trial Attorney in 1989, a distinction held by less than 1% of the bar. The Supreme Court has reissued this certification four times through to the present. I was named Master of the Richard Hughes Inn of Court, the highest designation of that organization, an association of trial attorneys and Judges. Super Lawyer magazine has listed me numerous times. All of these entities can be contacted to verify the status and method of awarding recognition.

I have handled cases from murder to speeding and have represented thousands of clients. I have appeared in nearly all the Municipal and Superior Courts of N.J. as well as the Federal District Court of N.J. I handle all cases in the office personally.

My office philosophy is to prepare and argue every case, no matter how minor the charge, as if it is a homicide. I always attempt to resolve matters with the least risk to my clients at the lowest cost possible. The aim in every case is dismissal or acquittal. I hate to lose.

Q. Can you be indicted for 2C:35-5b(2) and 2C:35-5b(3) with the same person and the same drug
A: Sure. More than one person can possess the same thing. The issue is the weight.
Q. Can the same cop give me a ticket for the same exact violations from a day before meaning 2 days in a row
A: More information is needed. But if you violated the same law two days in a row yes he can.
Q. Boyfriend in jail. On 12/5/17 was released by judge still being refused release by jail on 12/7/17
A: I would contact his attorney and see if the condition can be revised. Otherwise I agree with M. Aalsberg.
Q. does an investigator have to state a specific incident in Wich to show that they tried a specific investigation tactic
A: It is difficult to understand your question without more information. The cop can question without indicating their purpose if that is what you are asking.
Q. My Speeding ticket does not show up online and the speeding ticket doesn't have a court date. What do I do?
A: Call the court. They will know the date and how to pay.
Q. If I have a DUI in NJ, can I enter Canada without issue since it is a traffic offense and not criminal?
A: I also have heard that it is a problem. NJ says it is not criminal Canada says it is.
Q. I was rear ended by a tractor trailer but received a ticket for illegal lane change.
A: You must speak to a PI attorney immediately. If the case was dropped liability is likely established. Your damages can be recouped. Hurry though because there may be notice restrictions depending on the status of the truck and driver.
Q. If a teacher refuses to follow emergency evacuation procedures deliberately, what law does that fall under?
A: It depends who asked them t to leave
Q. Passenger of a vehicle that was pulled over, the driver had a license, registered and insured can the pasngr be searched
A: All motions to suppress evidence are iffy things. They will need to show the ID information or it may be a no go for them. Problem with MTS is to fight them you normally need to reject a plea offer so it is all or nothing. Possession of a handgun is 2nd degree with presumed prison 5-10 years and it is Graves Act to 1/3 to 1/2 must be served before parole. That is a big bet on a MTS.
