Magdalena practices in the area of immigration and nationality law, focusing primarily on family-based immigration, citizenship, waivers and appeals, as well as removal defense. She has represented clients before the United States Immigration and Citizenship Services (USCIS) and the Executive Office of Immigration Review (EOIR).
While at the Law Firm of Shihab & Associates, Magdalena has worked on a wide range of family-based immigration matters including Asylum, VAWA and U Visa claims, Inadmissibility and Unlawful Presence Waivers, J-1 Waivers, Family Petitions, Fiancé(e) and Spousal Visas, Returning Resident Visas, Removal of Conditions, Naturalization, and DACA cases. Magdalena has also worked on various applications for relief for clients in removal proceedings including Cancellation of Removal, Discretionary Relief and Voluntary Departure. She has drafted Appeals with the Board of Immigration Appeals, and has experience filing mandamus actions in Federal Court to compel USCIS and other federal agencies to issue decisions on delayed applications.
