A: I am sorry this happened to you and hope you are on the mend. You possibly have a case - whether you do or don't is very fact-specific. It certainly merits investigation. If the apartment complex failed to take steps to prevent crime in an area it knew had a high rate of crime, it could be held liable. It sounds as though the complex had knowledge of some crime because they hired a security guard. If that guard had a history of not reporting for duty, then the complex can potentially be held liable for failing to take additional steps such as hiring a different company to staff security guards. Also, if the complex failed to repair the gate which allowed non-complex dwellers into the complex, and such a person stabbed you, the complex can potentially be held responsible. Q. My daughter is being sued for an accident that the other driver was cited for. We are in Florida.
A: Your daughter should contact her insurance agent and forward a copy of the lawsuit to her insurance company as soon as possible (and make sure it is received). I am not licensed to practice law in Florida, but I believe an Answer to the lawsuit must be filed within 20 days after service of the lawsuit so time is of the essence. The insurance company will appoint an attorney to defend your daughter.

A: Your aunt's husband or, if she wasn't married, surviving children, should contact a medical malpractice attorney in Georgia as soon as possible to investigate this matter. An MRI is usually contraindicated with someone with a pacemaker or other metal objects.

We are currently handling a case where an MRI technologist left EKG leads on a patient and he suffered a significant injury as a result.
