Q. I have a wage garnishment for a credit card. The company hasn’t sent me any statements. Can I take them back to court?
A: In Maryland, the Creditor that is garnishing you must provide Judgment Creditor’s Monthly Report to both you and your employer within 15 days after the end of any month in which payments are received. If they are not providing same to you, a Motion can be filed for sanctions. This report will show you your balance, how your payments were applied, and how much interest is left. It is a mandatory form.
Q. I plead guilty to 2nd Degree Assult (To try and move on without trial). I'm now being sued for an injury.
A: I am unclear who is suing you, however, if you have homeowners' insurance, depending on the circumstances, you should reach out to them directly. Otherwise, you should hire a Maryland attorney immediately to defend against the action. You may also have certain exemptions to protect your retirement from garnishment.
Q. I'm half way through a two year lease and the landlord contacted me saying she wants to sell the house.
A: In Baltimore City, tenants have what's called the first right of refusal, meaning, your landlord must offer to sell the home to your first prior to listing the property for sale. Otherwise, the 60-day notice is appropriate and lawful in Maryland.
