"We Won!!" was not something Josh heard a lot as a kid.
Never the sportiest fella, East Cobb, Georgia didn't inspire him to a sportsball career despite his innate athletic ability. Graduating from The Walker School Josh went North, to Clark University, MA (Hippies and folks from New York, and SO MANY international people!). Chasing young love back to Georgia, Josh graduated from Georgia State University College of Law in 2002 without any honors. He was on Mock Trial and did Moot Court, though. And was fun.
Josh clerked in Cobb Superior Court (A. Grubbs), closed real estate during the boom, and then figured out that Talking was what he really liked so Josh became a PD. LOVED IT, but it was awful to participate in a system that was so broken.
in 2007 Josh graduated from Gerry Spence's Trial Lawyers College in Wyoming (www.triallawyerscollege.com/), quit working for the State and hung out a shingle. Wandering Solo was a bore, so Doug Chanco (former #JerkProsecutor Josh fought with all the time) argued with Josh to partner with him, and Doug won.
Now "We Won!" is a touch more common...

- Q. How to file for uncontested adoption in Georgia without formal paperwork?
- A: With those facts I downright beg you to get a lawyer involved, have you tried your church or some social groups for support?
DFCS may also have some guidance and may even have forms or a lawyer who can assist, its just that they are overworked and under-supported by the Gov so they are stretched.
A basic adoption is just VERY specific form completions. But VERY specific.
The issue with the non-present Dad is where it gets sticky, as the courts will inquire about the paternity before terminating any rights that have not been pursued.

- Q. How can I help move my wife's ongoing Georgia case with declined diversion?
- A: Super tough answer, as each court has very different processes, and some of those processes are under a constant state of redesign. I have cases in Cobb, Fulton and Gwinnett where the "diversion" process moves on and off the table multiple times during the evolution of the case, and just closed one that was almost 5 years old where we FINALLY got diversion as the "official" end.
The best course is to have a clear discussion with her attorney about the process and where the case is. The atty likely does not want to provoke the ire or annoy the State/Court for strategic reasons, and that is why sometimes the best path is simple patience.

- Q. How to secure an Order of Protection for my child against abuse and neglect?
- A: There are no reasons a child should be physically abused and if DFCS is failing (typical) then your next stop is Law Enforcement. You will also benefit from a lawyer to ensure your child's complaints are being heard. Even if that means asking a judge to assign a Guardian Ad Litem for her.
So go to the cops AND go to your family lawyer, as there are multiple available remedies.
