"We Won!!" was not something Josh heard a lot as a kid.
Never the sportiest fella, East Cobb, Georgia didn't inspire him to a sportsball career despite his innate athletic ability. Graduating from The Walker School Josh went North, to Clark University, MA (Hippies and folks from New York, and SO MANY international people!). Chasing young love back to Georgia, Josh graduated from Georgia State University College of Law in 2002 without any honors. He was on Mock Trial and did Moot Court, though. And was fun.
Josh clerked in Cobb Superior Court (A. Grubbs), closed real estate during the boom, and then figured out that Talking was what he really liked so Josh became a PD. LOVED IT, but it was awful to participate in a system that was so broken.
in 2007 Josh graduated from Gerry Spence's Trial Lawyers College in Wyoming (www.triallawyerscollege.com/), quit working for the State and hung out a shingle. Wandering Solo was a bore, so Doug Chanco (former #JerkProsecutor Josh fought with all the time) argued with Josh to partner with him, and Doug won.
Now "We Won!" is a touch more common...

- A: Commonly putative victims want to clarify the reported details of their incident, and unfortunately that comes with a load of consequences. The State can and WILL use any clarification as alleged evidence of abuse and control, and try to substitute their judgement for the witness's.
While horrible, the system is set up to assist the state prosecute more than take into account the truth or the alleged victims perspective.
Therefore you need to talk to an attorney in order to both best protect YOUR rights (the State will accuse you of crimes if they want) as well as assist the defendant in getting the best defense.

- Q. If the victim has written a statement saying it was an accident and doesn't wish to press charges how am I being charged
- A: Regardless of actual evidence, the elected executive prosecutor in your jurisdiction has final say on what charges are presented to the Grand Jury or directly accused. That doesnt mean anyone is Guilty and your evidence is both RELEVANT and ADMISSIBLE.
Many, many cases have alleged victims who disagree with the State's perspective and it is up to the lawyers and court to ensure the truth comes out.
Basically, you cannot prevent someone from getting "charged" as that is up to the State, but your first amendment makes an actual CONVICTION very hard for them.
- Q. How can I as the victim modify the bond so my spouse can come home?
- A: If the defendant has a lawyer, try to facilitate with them as it sounds like a simple bond modification is what you need and they will be able to file for it.
If you want to go ahead by yourself, you can petition the court independent of the case for a bond modification, but that is very rare.
Be careful with interactions with the prosecuting agency or anyone working with them such as a Victim/Witness advocate. These advocates are known for bullying complainants and misleading the Court as well as Prosecution. DO NOT TRUST them blindly.
