"We Won!!" was not something Josh heard a lot as a kid.
Never the sportiest fella, East Cobb, Georgia didn't inspire him to a sportsball career despite his innate athletic ability. Graduating from The Walker School Josh went North, to Clark University, MA (Hippies and folks from New York, and SO MANY international people!). Chasing young love back to Georgia, Josh graduated from Georgia State University College of Law in 2002 without any honors. He was on Mock Trial and did Moot Court, though. And was fun.
Josh clerked in Cobb Superior Court (A. Grubbs), closed real estate during the boom, and then figured out that Talking was what he really liked so Josh became a PD. LOVED IT, but it was awful to participate in a system that was so broken.
in 2007 Josh graduated from Gerry Spence's Trial Lawyers College in Wyoming (www.triallawyerscollege.com/), quit working for the State and hung out a shingle. Wandering Solo was a bore, so Doug Chanco (former #JerkProsecutor Josh fought with all the time) argued with Josh to partner with him, and Doug won.
Now "We Won!" is a touch more common...

- Q. Hi so I’m a victim in a domestic violence case, the DA, victims advocate and investigator came to my house but I didnt
- A: Unfortunately no, and the "Victim Witness" is one of the most difficult folks to interact with if you are involved with a DV case. They work for the State and against the defendants penal interests. Regardless of whether you work with them, they are working for the Prosecution and that means any interaction, even if meant to support the defendant, generally flows against the defendant. They present a major challenge and if you want to support someone who has been arrested, work with their defense attorney. Not showing up does NOT mean the case gets dismissed, and in fact it can be used to show that you are SO SCARED you will not even attend court. It is a terribly difficult situation. Talk to the defendants lawyer if you want to help the Defendant.
- Q. I pleaded guilty to domestic violence, in GA. on 06/27/2022. How much time I have to file motion to withdraw?
- A: Generally within the term of court you’re fine. I’d have to check the dates for Forsyth. Do you want to talk with your lawyer at length before making that call valve because once you file there’s basically no shot at ever getting a plea that good again. So you really need to be sir. Judges don’t take kindly to it either
- Q. Can a person with a TPO carry a firearm?
- A: The answer is almost always case specific with the default position being "no." Check the order that was actually issued and it should directly address firearms. Especially if the TPO is DV related, the courts are very wary of firearm possession when there are such emotional issues before it.
