Summary

I always knew I wanted to do something in consumer protection. I started my first career out of graduate school as a policy analyst in the Office Of Public Safety for The Mayor of The City Of Los Angeles. I helped increase the quality of life of 12 million Angelenos and did not know any of them. So, I decided to move back to Cleveland to help the people I grew up with, saw on a daily basis, shared interests and cares with, and came to know and call friend.

II went to law school to do just that. Corporations don't need help. They have high-priced lawyers in really tall buildings that charge them a lot of money to help them when they get in trouble. I have always worked for "the people." That's just where my heart is.

I help people with financial troubles, navigating through Chapter 7 and and Chapter 13 bankruptcies to help them save their homes from foreclosure, cars from repossession, and stop lawsuits and garnishments. I also represent people who bought crappy cars from used car dealers, had home renovations done from horrible companies, and were taken by foreclosure "rescue companies" that take your money and do nothing for you.

Unlike other attorneys who are located in other parts of Ohio, and have an empty office in Cleveland so it looks good for Google, I am a REAL attorney and I have a REAL office and I will meet you IN PERSON to discuss your issues - because I LIVE and WORK IN the Greater Cleveland Area.

Q. If my car is in a chapter 13. If the car is payed off will a trustee adjusts payments accordingly
A: No. Your payment is your payment unless you file a motion to modify your plan payment. That is an entirely different question. The money you pay to the Ch. 13 Trustee just goes to pay off the other creditors of your case, based on how your Chapter 13 plan is structured.
Q. If I decide to get married, will my new spouses income be garnished if the debt was mine?
A: No.
Q. As an officer of a 501c4 corporation am I personally liable for a copyright infringement by the corporation
A: Can't even answer without knowing more. Please call to set up an appointment.
Q. Can you file bankruptcy on credit card and medical dept only?
A: That is not a question that can be answered in this thread. That, most likely, takes a consultation; an understanding of how bankruptcy works and how it is different than debt consolidation. If you want a shock answer it will be, in my opinion, never do a debt consolidation. But, I cannot say that definitively because I do not know your circumstances. I would like to schedule a consultation to talk with you to discuss.
Q. Can I file bankruptcy alone?
A: I'd have to take a look at what your Separation Agreement says, but there would be no impediment to discharging all of this debt as to the original creditors. The Separation Agreement could cause issues if there was an assumption of debt provision.
Q. Does the CH13 applicable commitment period begin from date of 1st payment or confirmation date?
A: The APC is 60 payments, not 60 payments from confirmation.
Q. I have a question regarding my out of pocket school expense. My question is would I be able to file bankruptcy on that
A: What are those expenses comprised of? credit card, a loan from the school, a grant, etc.. Without knowing that, I really can't tell you whether its a debt and whether its dischargeable in a bankruptcy.
Q. Can you appeal if your petition to file bankruptcy gets rejected?
A: There are a lot of missing facts, here. What were the circumstances surrounding your filing and the dismissal?
Q. Can a credit card company that has begun the process of suing,be excluded from a bankruptcy filing?
A: Whoever that lawyer was, RUN from them. lol. In any bankruptcy filing, all of your creditors must be notified of the filing of the bankruptcy. How you want to treat them and whether they are discharged (or you continue to pay them) in your bankruptcy are questions/issues you should speak with a Bankruptcy attorney about. There are many variables that go into the treatment of certain creditors. With that being said, a credit card company (whether they are suing you or not) will be included in your bankruptcy. And, unless they sue you for non-dischargeability and win, it will be discharged.
