- Q. Can the police release your personal details (photo, name etc) to the press even before a trial?
- A: Normally, they can.
- Q. Does a driving while drinking charge get reporteted to the dmv
- A: If you are license is from Virginia, then yes. If your license is from another state, then it may be reported but it depends on what state.
- Q. If I was arrested under DUI, am I a criminal? How can I clear my record if it has been 5 years ?
- A: A DUI charge is a criminal offense. If you are convicted, it will never go away. If the DUI was dismissed or dropped (nolle prosse), the underlying police records and court records (the arrest) would still be there. However, you would be eligible for an expungement which would remove those public records. If you were convicted of a DUI, then you are not eligible for an expungement.
- Q. Can a person represent themselves for a dwi conviction
- A: Your question asks representation for a dwi "conviction". If you been convicted, you don't need representation at that point, unless you are seeking an appeal. At all levels in the judicial process, you may represent yourself, although it is not advisable to go it alone.
