- John has experience in a variety of complex corporate and securities matters, including class action securities fraud litigation (representing both corporate and individual defendants); disputes arising out of complicated commercial transactions (including contract disputes and derivative litigation); and disputes involving matters of corporate governance (including challenges to actions by boards of directors and the indemnification of directors and officers of public companies). John regularly represents public companies, investment advisers, and individuals in connection with investigations conduced by the United States Securities and Exchange Commission and the Department of Justice. Among other matters, John recently represented an independent director in a two week long evidentiary hearing that established the director’s independence for purposes of a breach of fiduciary duty claim. John also helped to secure a successful result following a three week trial for a public authority in a high profile litigation arising out of a planned construction project. In 2001, John served as a Special Assistant District Attorney in the Middlesex District Attorney’s Office, where he prosecuted more than a dozen jury trials, and argued evidentiary motions and arraignment-related matters on a daily basis.
