Q. What does it mean if my attorney released my case?
A: Every firm as their own criteria of cases they will handle. They may have released his case for any number of reasons. It could be something to do with the case itself or something to do with their internal policies. Oftentimes cases are released because there is no insurance coverage, the client may have been at fault for the collision, or the firm may have a conflict of interest. I suggest calling them to get more details. If you're not satisfied with the response, then call other P.I. attorneys for a second opinion. Good luck!
Q. Is it true I can be held accountable partially for failing to recognize danger if I didn’t see a car coming my way?
A: Unfortunately, this happens quite a bit. Insurance companies try to minimize their exposure by partially blaming all parties involved. You can certainly fight their position with the help of witnesses, photos, or near by cameras. I suggest chatting with a PI attorney about your case to go over all your options.
Q. What happens when you get sued but don't have the money to pay and you can't afford a lawyer?
A: You boyfriend's insurance company is obligated to defend him as long as he had an active policy at the time of the crash and that he is cooperating with them. They will provide a defense attorney and pay for any settlement or judgement up to the limit of his policy. Anything in excess of that, may be his responsibility to pay. That being said, Texas has a very broad exemption laws to protect an individual's personal assets from a judgment in cases like this. I suggest your boyfriend speak with his insurance company/defense attorney to discuss the specifics of his case.
