Jennifer Nicole Brown

Jennifer is a native of Northwest Ohio. She graduated Cum Laude from Bowling Green State University with a Bachelor of Arts in English in 1996. After completing her undergraduate degree, she worked for two years at a local counseling agency as a mental health social worker for chronically mentally ill patients, networking these individuals with community resources and providing supportive services to prevent in-patient hospitalizations.

She continued her education at The University of Toledo, College of Law, graduating Cum Laude in 2001. She began her career at the firm in March of 1999 as a law clerk. After she passed the bar in November of 2001, she joined the firm as an associate attorney. In July of 2007, she became a partner with the firm.

Jennifer was born in Hicksville, Ohio. She was admitted to the Ohio bar in 2001. She resides in Defiance, Ohio with her husband Jay and their sons Phillip, Cameron, and Kaiden. Together, Jennifer and Jay enjoy involvement in the community through the fostering of children in their home, participation in church events, serving on boards, and public service opportunities, such as mission trips. They love the outdoors where you will find them at playgrounds, baseball games, and fishing.

A: The potential answers to your question depend, in part, upon some facts not included in your summary. In Ohio, the Certificate of Title is evidence of ownership pursuant to Ohio Revised Code 4505.04.

Did your husband transfer title to the vehicle to the new owner, or is the title currently still in his name? If the vehicle is still in his name, then he can show to a court that he still has an ownership interest to try to recoup his money, although there may be disputed testimony over the purchase price without anything in writing.

If he transferred the title, then she became the owner upon the transfer of title. If he has no evidence of the agreement to pay for the vehicle, he may have difficulties getting a court to recognize his interest in the titled good absent her admitting that he is/was the owner, and she still owes him money. See Revised Code 4505.04(B)(2). He would also have a trouble placing any lien without proof of an ownership interest or security interest.

Most seller hold title until the payment for the vehicle. Those that finance vehicles, such as banks, typically file to perfect their security interest under Ohio Revised Code 1309.
