- Q. Someone is trying to sue me for theft an accomplice with someone else and they have no proof or evidence on me but they
- A: It looks like you submitted the question without completing it. Is this someone you know? Are the police involved? As with any case, complete facts will assist in a thorough analysis of your case and any potential resolutions.
- Q. In 2009 I was convicted of felony charges (forgery and commercial burglary)
- A: It is possible to clean up your record, yes. Via PC 1203.4. Certain rights may be restored if the charges are reduced pursuant to 17b, as well. This is not automatically granted by the judge, however, since you mention you violated probation. It would be worthwhile for you to consult with counsel who handle these types of motions. Specific details are always important to discuss prior to filing these motions in court.
- Q. Can I be fined for a petty theft even if cops were not called
- A: Did you receive a Civil Demand Letter? This is oftentimes sent by a law firm representing the retailer that was possibly involved in your case. This is not stemming from criminal action in the case and is not ordered by a court.
