Jason Neufeld is the founder of Elder Needs Law, PLLC, and is proud to represent senior citizens and younger disabled adults in various matters including Medicaid Planning, Estate Planning, Incapacity Planning and Probates throughout Florida.
Since 2012, Jason has been honored as a "Super Lawyer" by Super Lawyer's magazine and a "Legal Elite" from Florida Trends magazine. Jason earned his Bachelors of Arts degree from Emory University and obtained his Juris Doctorate and Masters of Business Administration (JD / MBA) degrees from the University of Miami.
Jason is on the Board of Directors of the Academy of Florida Elder Law Attorneys, North Dade Bar Association, North Miami Beach Chamber of Commerce and the Broward Coalition on Aging. He is also a member of the National Academy of Elder Law Attorneys and a Leadership Broward Class XXXII (Aroo!) Graduate. Jason sits on the Miami-Dade Mayor's Initiative on Aging Subcommittee of the Consortium for a Healthier Miami-Dade.
Jason has previously sat on a 11th Judicial Circuit Grievance Committee and was honored with a proclamation (Jason Neufeld Day) from North Miami Beach Mayor Rabin in 2007 for his civic activism.

- Q. My 86 year old mother in law is about to go into an assisted living facility, but may need to apply for Medicaid.
- A: In Florida, the answer is: Yes.
If the automobile in question is mom's only car - it is an exempt asset (that Medicaid was never going to count against her when determining eligibility anyway).
For non-real estate/non-retirement assets (such as a car) which are already excluded, Florida Medicaid will not impose a penalty on gifting such non-countable assets away.
You are doubly protected if you can show that you gifted the car to mom in the first place. This would allow you to take advantage of the fact that reimbursements are allowable (i.e. mom isn't gifting it away, she is returning something she never paid for).

- Q. How can my mother structure my brother's SNT to avoid funds becoming "marital assets" in the event of his divorce?
- A: Your mother can create a Third Party Special Needs Trust (it can be embedded in her Living Trust or stand-alone). Mom can/should name anyone OTHER than your brother to serve as the trustee for this SNT with him as beneficiary. As an example: you could be trustee for your brother (in charge of managing his SNT trust funds).
I would not recommend using any of the SNT funds to give money directly to your brother. The SNT could, however, pay any of his bills. These trusts are structured as "sole benefit" trusts which should prevent it from ever being considered a marital asset.
