Q. Whats higher a trademark or corp?
A: A trademark and a corporation have completely different purposes. A trademark is to protect consumers by granting one company the right to use an identifying word or symbol to show products or services provided by the company. A corporation is a legal entity.
Q. Can I trademark a name and tag line all at one
A: You can combine the name and tag line in one trademark application but that might limit your ability to enforce them when used separately.
Q. I trademarked PhysicianFit.com B4 a co. trademarked PhysicianFit. How good of an infringement case do I have, if any?
A: Did you trademark the domain name or did you register the domain name, there is a large difference as far as your legal remedies go. I suggest you speak with a local intellectual property attorney to discuss this matter.
Q. Copyright infringement
A: Most likely the answer to your question is no, you cannot use a song without permission of the copyright holder. If the song is in the public domain you may use it.
Q. Are the Olympic Games broadcasts legally protected?
A: Yes, they are protected under Copyright law.
Q. Is there any way to make your trademark registration anonymous as it pertains to the owner of the mark?
A: The owner of the mark can be a corporation, but the owner of the corporation will also be public record. I suppose you could create several sub corporations but eventually the owner of the mark could be discovered.
Q. Is my trade mark still mine, if I want to reopen my business?
A: The answer to your question depends on several factors, including: the length of time you operated the business, the notoriety you had while operating the business, whether someone has begun using the name, how long ago the business ceased operating, as well as several other factors. I suggest you speak with an intellectual property attorney about this matter and provide the full details.
Q. If I take an image of Fred Flintstone and altar its appearance to use on a flyer, is that copyright infringement?
A: If you can still tell it is Fred Flintstone then most likely, yes.
