Q. Is my separated spouse in CA entitled to take all marital assets?

A: No, one spouse is generally not entitled to take all marital assets. California is a community property state, requiring equal division of marital assets. Once a divorce is filed, Automatic Temporary Restraining Orders (ATROS) go into effect, preventing either spouse from transferring, hiding, or disposing of property without consent or court order.
