I am Ian E. Scott, the founder and Managing Partner of Scott Legal, P.C. I hold a law degree from Harvard Law School and have also earned an undergraduate degree and an M.B.A from the University of Toronto in Canada.
In addition to my legal qualifications, I am a Certified Public Accountant (C.P.A.) and have gained valuable experience working at Credit Suisse Investment Bank, the Bank of Montreal, and Ernst & Young.

- Q. Can I set up an LLC for F-1 OPT work and be a 1099 contractor?
- A: It is fine to be self employed for regular OPT as long as your degree is related to what the business does. It is always a good idea to set up a company and take any other steps to show that your business is legitimate. (eg. set up a website, operating agreement, EIN, etc.). Stem OPT is much more complicated. The company must be E verified and you also need a training plan and supervisor. For Stem OPT, you must follow certain rules.
- Q. Can my girlfriend from New Zealand apply for a green card if we marry while she's on an ESTA in the U.S.?
- A: Adjusting status is possible when you marry a US citizen even if you entered on ESTA. Once the I-485 has been filed, the applicant cannot leave until travel authorization has been obtained. Ideally the applicant entered without the intent to adjust but there is case law that could deal with this even if they did. You can also apply for work authorization once the I-485 has been flied.
- Q. Visa options for long-term stay with U.S. citizen partner without marriage.
- A: One option may be an investor visa like E-2 or EB-5. The E-2 is available to nationals from certain countries and allows people to stay in the US long term even with a small investment (eg. $100K). There are about 80 countries on the list. One green card option would be an EB-5 if you could invest either $800,000 or $1,050,000.
