Biography

Howard E. Knispel has been practicing law since 1989, having graduated from Eisenhower College of World Studies of the Rochester Institute of Technology with a degree in International Politics in 1981 and New York Law School in 1988 with a Doctor of Jurisprudence.

Howard concentrates his practice to Divorce, Family Law, Bankruptcy, Criminal, Traffic and DWI, Real Estate and Wills. Howard has conducted numerous trials, both jury and non-jury. Howard has negotiated and settled hundreds of divorce, custody and support matters.

Howard has helped many people get out from crippling debt to get a fresh start. He has assisted many people experiencing criminal matters help get the possible outcome, including dismissals. As a former traffic prosecutor and Administrative Law Judge, has helped many cut through the tangle that is the traffic court and helped reduce points and save licenses. Q. Plaintiff seeks half of house equity post-divorce, name added to title years prior.
A: Regardless of when the property was purchased, the act of adding your spouse to the deed is called transmutation, thus making it marital property. This does not mean it would be divided equally, but equitably. The distribution percentage depends on the pre-marital credit you might be entitled to. You need to speak to your attorney about investigating that credit.
Q. Can criminal charges arise from receiving child support after losing custody in NY?
A: A person can not go to jail simply for receiving child support under a valid child support order. However if the person lied under oath in court about where the child lives, whether the child was emancipated or if service of process was validly effectual, those are criminal perjury.
Q. How to plead not guilty for speeding ticket in snowy conditions?
A: You need to enter the plea on the ticket and mail it in (keep a copy). You need to do this before the date on the ticket. You can bring it to the traffic agency and enter the plea there. Arguing you were going too fast in snow is not likely to be a winning argument however. You should speak to an attorney.
