Q. brought home frm estate, exec never had Ok from court to sell how can i get clear title if exec is in another state. PA
A: I concur with Mr. Snyderman that you should begin with the title insurance underwriter. It sounds like you may have a fraud claim (these are governed by a two year time limit), which could be a basis for rescission if you are willing to file suit. You should confer with an attorney immediately as the value of property and resale ability are obviously impacted. Also, you may want to explore a quiet title action if there is another ownership interest that can be extinguished. However, at the end of the day, you should have insurance coverage which would also cover the carrier's lawyer assisting to clear up this title defect.
Q. Do I need a lawyer to sell my house?
A: Although I agree with Mr. Snyderman that there is no actual requirement that one must utilize an attorney to sell his/her house, the disclosure laws in the Commonwealth of Pennsylvania can be quite strict, considering that even an innocent misrepresentation can be actionable after the real estate is transferred. In my experience, ensuring that the proper disclosure is given, even before an offer in made by the buyer, can be an extremely important part of the process. Once the agreement is signed by both parties, generally the buyer's agent or the title company will request information from the seller. A lawyer may also be able to simplify those questions or to tender the necessary information.
