Q. If convicted on a DUI in a non-sr22 state (i.e.; Pa) do I need sr22 in South Carolina when I get my license here? Now SC
A: Yes, South Carolina will require that you get SR-22 insurance and may require that you take an ADSAP course. Contact the DMV in South Carolina to find out what additional requirements they may have for you.
Q. Is there anyway to get a wreck less homicide conviction expunged? It was from a dui accident that happened when I was 20
A: A Reckless Homicide is outside the classes of crimes that normally can be expunged. In rare cases, you can get a pardon. Consult a lawyer that deals with pardons and expungements.
Q. My DUI was dismissed but the DMV told me I couldn't get my DL back. What can I do
A: The DMV will require that you complete the ADSAP (Alcohol & Drug Safety Action Program) in South Carolina. If you complete this program then you can get your license back as long as you don't have any other holds on your license.
Q. What am i facing for a 1st dui and 3 child endangerment in sc
A: Here is the short answer. The DUI could land you in jail for up to 30 days and the child endangerment charges could have you in jail for up to 15 years. It is important for you to consult a lawyer as soon as possible to defend you on your charges.
Q. Can a dui in South Carolina be dropped for racial profiling?
A: The short answer is "yes" but racial profiling that is not accompanied by a criminal act can be dismissed at the evidence phase of the case if certain factors are present. However, if during a stop based upon racial profiling there is found to evidence of a crime, then it is more difficult to secure a dismissal. An officer is allowed to pull someone over on suspicion of a crime, that is a part of their job to keep communities safe, but it is important to challenge an arrest that you feel is unfair. The US Constitution gives you the right to a fair trial. If you want to challenge your arrest it is important to get a lawyer of your own choosing right away.
Q. My husband is charged with criminal solicitation of a minor and posetion of meth in sc will he do time in jail
A: Yes, jail time is possible. It is important for him to consult a criminal defense lawyer of his own choosing and find out what his options are based upon the facts of his case.
Q. Can I be let go from my job because I'm having surgery and I'm under workers comp at this time
A: Yes, you can be let go. South Carolina is one of the states that will allow an employer to fire you for no cause, good cause or any cause. However, you cannot be retaliated against for filing your workers compensation claim.
Q. If I got any DUI and I got my license back in January I behave gotten two speeding tickets will this affect my probation
A: Any subsequent arrests that you have while on probation could result in a probation violation. Consult a lawyer to defend you at the hearing. If you do not have counsel and you are violated at the hearing, the judge could sentence you to serve the amount of time hanging over your head that was suspended to probation.
