- Q. In the state of Texas, can an 18 year old go to jail if they had sex with a 15 year old when they were 17?
- A: It depends on the charge- Yes if statutory rape because it is a strict liability case and as long as it happened, you are guilty and unfortunately consent is not a defense and since the age of the defendant is 17, the court can charge him as an adult. No if the charge is not statutory rape- which in that case, consensual sex defense can be used.
