Eric Valente, JD, MBA, is an attorney and founding member of Valente Law, LLC. He studied business administrations and earned his MBA while attending law school at the University of Toledo. Eric began his career doing business litigation at J.W. Krueger & Associates, LLC, where he still maintains an office. Eric has always had a creative, entrepreneurial spirit, and estate planning and business counseling provides him with the opportunity to engage these interests while helping clients achieve their goals. He currently lives in Lakewood, Ohio with his wife and enjoys traveling, spending time outdoors, staying active and taking advantage of all that Cleveland and Akron have to offer. Q. i have tenant who lease is up on March 1st as a landlord can i accept the rent for March then give them a 30 day notice
A: Yes, you can accept the rent due for March, and file the 30 day notice. You cannot accept rent for April, however, if you intend to follow up with a 3 Day Notice to Vacate and proceed with filing for eviction if the tenant does not vacate.
Q. Another question regarding my eviction dismissal..
A: Yes, the landlord is permitted to refile the complaint for eviction for future nonpayments. The dismissal would only cover the prior eviction. If you do not pay timely in the future, the landlord can file again.
