Q. Our divorce says child support ends when child turns 18 or graduation high school My son is graduating high school soon
A: If there is no income deduction order, you can stop paying once your son graduates from high school and turns 18.
Q. I have attempted to contact several attorneys for child custody modification and cannot afford $7,500.
A: Without knowing more facts of your case, it is impossible to tell you what you will need to take to court with you. Custody actions are complicated. You should not attempt to go it alone. There are attorneys who will do payment plans that may be able to better assist you. You should attempt to find an attorney that may be able to work within your budget to protect your children.
Q. If my 3 children were born before I married their father, does the marriage legitimize him as the father?
A: Yes, the marriage legitimized the children.
Q. Judge just issued Order ex-husband’s Modification Denied. Can he re-file under new grounds immediately?
A: In order for him to re-file, he must first show that there has been a material change in circumstances since the entry of the last order. You should speak with an attorney at least for a consultation to determine if his allegations in his new petition for modification rise to that level.

A: Reports to the Department of Children and Family Services are confidential.

A: The only way to protect your rights to your son are to file a legitimation action with the courts. Until you do so, you have no rights to custody or visitation and will be at her mercy as to when you can spend time with your son.

A: It is not as simple as signing your rights over to someone else. The Department of Children and Family Services will have to approve any placement unless there's a court order of custody otherwise.

A: If your current parenting plan order requires her to take the child to extracurricular activities, she can be held in contempt for failing to do so. If the order does not address it, you will need to file a petition to modify the order.
