Q. Are programs allowed to record your voice without consent? How would I go about pursuing legal action?
A: Check the software/company's terms of service or privacy policy to see if they disclose anything about recording voice data and check your state/country's laws on recording to be sure you have a solid claim.
Q. If you have been selling fanart (possibly illegally) what is the process if the copyright holder decides to take action?
A: The copyright holder (or their legal team) often starts by sending a cease and desist letter. After the cease and desist, there might be a period of negotiation or mediation to try and resolve the situation without going to court. This could involve agreeing to cease sales permanently, potentially discussing a limited license to sell the fanart with royalties paid to the copyright holder (this is less common), or paying a settlement amount to compensate for past infringement.
Q. I want to create a website that hosts fantasy football contests for money. Is this legal?
A: Many states have laws specifically addressing gambling. Some have exceptions for "games of skill," but the definitions and interpretations vary. In most states, to avoid gambling issues, there have to be no entry fees and prizes must be predetermined and not based on entry fee totals.
