Q. We currently have a case in SC but recently moved to OH... would we have to obtain a lawyer in SC or OH?
A: If you have an active domestic case in SC, that court retains jurisdiction. You would need to find a lawyer in SC. A motion can be made in that court to transfer the case to an Ohio court in very limited circumstances. This response is based on the limited facts you have provided and is not intended to create an attorney-client relationship. I cannot provide adequate advice to you without meeting with you in person. If you would like to schedule a consultation, please feel free to contact me.
Q. How can I get my rights as a father the DNA test is already done. I just don't know how to get my parental rights.
A: You will have to file a complaint in the appropriate court for the establishment of parental rights and responsibilities. Retain the assistance of counsel to advise you and to ensure that everything is done properly. This response is based on the limited facts you have provided and is not intended to create an attorney-client relationship. I cannot provide adequate advice to you without meeting with you in person. If you would like to schedule a consultation, please feel free to contact me.
Q. I lost my children due to allegations against my now deceased husband that were not proven. No charges were pressed.
A: Based on the limited information that you have provided, I would advise consulting with an experienced domestic relations attorney that can assist you with filing a motion to modify parental rights and responsibilities. Depending on who currently has custody of your children and/or who removed the children in the first place you might also have to comply with a "reunification" plan or something similar. This response is based on the limited facts you have provided and is not intended to create an attorney-client relationship. I cannot provide adequate advice to you without meeting with you in person. If you would like to schedule a consultation, please feel free to contact me
