Legal Answers
29 Questions Answered
- Q. contract signed on 6.24.2024 - still no luck with construction starting
- A: New York law does not set a specific timeframe for "goodwill" in contracts of this nature. Nevertheless, if the contract includes a clear start date or timeframe, repeated delays without a valid reason could breach the agreement. You may contend that their consistent failure to commence work as specified demonstrates a lack of good faith and a breach of contract. If they continue to give excuses, consider sending a formal demand letter stating that they are in breach of contract and requesting your deposit back. You can mention that failure to respond will result in legal action. Feel free to reach out if you have a follow up question.
- Q. Can a family member WAIVE THEIR RIGHTS TO A WILL inorder to put a deed to a home in another family members name
- A: If a family member wants to waive their inheritance rights under a will (e.g., to allow the property to go to someone else named in the Will), they may be able to do so by properly signing a waiver or disclaimer of inheritance. This does not directly affect the deed itself. It simply means that the disclaimed portion of the estate passes according to the terms of the will or, if no terms exist, by intestacy laws. Feel free to reach out if you have a follow-up question.
- Q. Church trustees. Can allowance be made for a trustee to serve more than 2 terms?
- A: Hello. You should be able to amend your bylaws to allow a consecutive term of a current trustee to serve another term. For your specific situation, you can include a clause in your church's bylaws that allows for an additional term beyond the standard two terms if there are no qualified members available to serve. This is consistent with common practices in other religious organizations. Feel free to reach out if you have further questions.
