Q. How do I get a felony expunged
A: if it is expungable you would move under 17b to reduce to a misdemeanor and under 1203 move to dismiss.
Q. domestic violence I got a letter stating I have to testify against my husband i told them I didnt want to
A: to try to get out of it hire a lawyer to coordinate with his lawyer and advise DA you are not going to testify if the facts warrant it
Q. Can you sue an employer if your info was released do to a data breach.
A: more info needed. anyone can sue for anything at any time............the issue is can you find a lawyer to do it on a contingency or will you have to pay hourly. Here I think it would be an hourly case in our office if we handled that kind of case.........................................AND were you damaged and can you recover any money. it doesn't make sense to sue to get a $1 verdict for instance and spend lots of money on a lawyer to do so. you have to show damages.............
Q. If I accidentally hit a parked car, but didn’t see any damage, do I still need to contact the car owner?
A: more facts needed..............but if you are contacted by police remain silent and say you want to talk to your lawyer for permission to talk to the police. technically you do not know what the damage might be to the undercarriage etc
Q. Someone charged with a 21810 PC, and 22010 PC, charged at a probation search? Criminal Defense? Things not on person
A: need more info. you should ask your lawyer who will have all the facts and be in a better position to address what I assume is a question of legality to possess combined with the court's order. 21810 PC: This crime is a wobbler with a maximum punishment of three years state prison. Penal Code section 21810 prohibits the possession of metal knuckles. This crime is a wobbler punishable by up to one year in the county jail or pursuant to Penal Code section 1170(h). Except as provided in Section 22015 and Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, or possesses any nunchaku is punishable by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision (h) of Section 1170.
Q. How is my pitchess motion supposed to be fair, when the same court that denied it the first time is doing it again?
A: much more info would be needed and you need to ask this of a criminal lawyer in Ventura. i am in palm springs and swore i would never go back to Ventura over 30 years ago. you might ask the court to appoint another defense lawyer if you feel you are not getting competent representation.........but i can't comment if that is a prudent idea.

A: more info needed. could you yes. but with a good excuse and a good lawyer probably not. talk to the lawyer who handled the original case who will have all the facts.
Q. My landlords dog attacked me (5 bites) as I entered the backyard of our house. Went to hospital for treatment. Now what?
A: More information is needed to fully understand the facts and to give an accurate answer. However, you are always best advised to retain a LOCAL lawyer in case you are charged or arrested. In other words, you do not hire an LA lawyer for a case in Palm Springs or OC and visa versa....and if you cannot afford a lawyer the court will appoint one for you. It's also important to not talk about this case to anyone except your attorney. Please remember anything you say herein, is discoverable and can and will be used against you. The problem with talking to an insurance adjuster on an accident case, is that they often misunderstand what you said or they do not write down everything. Often it is what THEY THOUGHT THEY HEARD YOU SAY that hurts you. You never want to admit to anything. You should consider retaining a lawyer and then remain quiet and let the lawyer be the strawman and take the heat. In other words, you would be happy to talk to the insurance co, but your lawyer has ordered you “not to talk without his permission”. You then suggest they talk to your lawyer for permission for you to talk with them.
