NICASTRO LAW, L.L.C.I have been enjoying the practice of law for 25 years. Probate and Estate Planning are my choice areas, where I find the most meaning in my practice. I assisted the executor with probating my first estate back in 1994. It was challenging. The Probate Court had a hefty estate recovery Lien on the file for past medical care, which had to be negotiated and paid off. There was also income from a personal injury case that had to be resolved, at which time I learned about the favorable tax laws as to income from personal injury claims. I was really able to help the surviving heir gain access to her funds--very satisfying. Fast forward, in 2012, the Uniform Probate Code MUPC, passed in Massachusetts to stream line the process. My first task, generally, is to petition the court to request my client be appointed by the court to serve as the personal representative, (formerly called the executor). There is a process with notifying heirs of the estate and MassHealth. Then if there are no objections, the personal representative is formally appointed by the Court. The next step is guiding the personal representative with his or her duties such as preparing an Inventory of the estate. I assist with the preparation of the inventory. Sometimes, there is real estate that has to be sold and no Will authorizing a sale. In these cases I petition the court for a license to sell. I also assist with filing the account for the estate and closing the estate so that the debts that need to be paid are paid and the proceeds can be disbursed to the heirs. I also work with seasoned accountants who can prepare the estate taxes, if any are owed. I also prepare estate plans, Wills, Trusts, Life Estates, with asset protection and for both young people and elders who have specific needs, including situations where nursing home care can be an issue. I enjoy working with my Client one on one; and being available to answer their questions to make the process easier.
