Professional. Thorough. Helpful. Pleasant As Carol said, if you don't do your estate planning during a pandemic, what could motivate you more? Carol was wonderful to work with. We did all of our meetings via Zoom and that went very well. She asked a set of very thorough questions and then patiently waited for us to come back with the answers. She educated us and walked us through the process, explaining each step along the way. She was very helpful when we were confused or unsure about difficult decisions, and we always felt she had our best interest at heart. She was prompt to all appointments and quick to respond to email, and extremely flexible. The last appointment was at her office which she was able to move outdoors with social distancing, because we needed to be physically present to sign documents. It isn't an easy thing to do, setting up an estate trust, but Carol made it easy and painless for us, and provided us with a very quick turnaround on the trust. We couldn't be happier about our choice to use Carol as our attorney.

Consummate caring, knowledgeable, integrity bound, tenacious, Professional As events in life sometimes happen, I was forced to obtain legal counsel for a two year period recently which was the last thing I would ever want. However, at least I had Carol Fauerbach in my corner. From the onset of my initial consultation, I knew Carol truly cared for my difficult situation and those impacted by it. I was impressed at Carol's level of knowledge and her forthrightness to not “B.S.” me in the one or two times questions were unanswered. Carol has entirely too much integrity to provide incorrect answers to questions or B.S. through a situation. Her tenacity to see things through was superior. As a retired US Marine, I am used to tenacity on the battlefield. Carol brings her own brand of tenacity to her work which rapidly earned my respect and appreciation and throughout our process together. Carol was the consummate professional ensuring I had been fully informed of all aspects of the case and helped me devise a plan moving forward. As my matter was ham-stringed with a larger than normal geographic separation, Carol was able to explain matters to me over the phone in a clear and concise manner which greatly assisted my overall decision making process. This also saved me money and time in travel expenses which is another aspect of Carol's services I truly appreciated. Carol was not out to nickel and dime me. She always had several options for the way forward which considered my desired end state, time, expense, and likely success. Q. How do I make sure when my elderly father passes away that my sister doesn't take all of his assets and keep them
A: As long as your father is not incapacitated, an attorney can assist him in preparing a Will or Revocable Living Trust to allow him to designated how his property would be distributed if he were to pass away. Advance Health Care Directive and Durable Power of Attorney documents are also important to make sure that your father designates someone who can assist him if he becomes unable to make his own medical or financial decisions. Your father should consult an attorney regarding his estate planning needs and options.
Q. Can my husband & I make changes to our living trust without using a lawyer, if our signatures are notarized? Thank you.
A: Although you and your husband can make changes to your trust, it is important to review the changes with an attorney to make sure that there are no unintended consequences, and to make sure that the changes are done in a manner that makes them legally effective and not likely to cause confusion or litigation among beneficiaries if you pass away or become incapacitated. It is a good idea to have your estate planning documents reviewed every few years to make sure that the they still reflect your current needs as well as changes in the law. Also, it is a good idea to consult with an attorney to make sure that your trust is funded appropriately.
Q. Is my grandmother the sole mortgagee of the house now?
A: She will need to continue to pay the mortgage payments. Depending upon how title was held on the house, probate may or may not be required. If your grandmother does not have an estate plan already in place and current, now is a good time to seek assistance from an estate planning attorney to ensure that there is no probate required for her heirs, and that she has designated individuals to handle her financial and health care needs if she is unable to do so in the future. Your grandmother should consult a probate/estate planning attorney to confirm what needs to be done to transfer the house to her name alone, and to establish an estate plan that protects both her and her heirs.
