Biography

Brandon Labiner is the founder of the Personal Injury & Accident Law Center, where he represents injured people across South Florida against insurance companies and the people who hurt them. He knows the importance of obtaining adequate compensation for his client’s peace of mind and the bottomless resources insurance companies will expend to defend against claims. Brandon represents clients in the areas of personal injury, bodily injury insurance claims, and uninsured/underinsured motorist claims throughout the Palm Beach, Broward, and Miami-Dade area. He takes pride in fighting the insurance companies to obtain the compensation his clients deserve whether they have been injured in a car or truck accident, slip and fall, dog bite, or a case involving the negligence of a property owner or medical professional.

He received his Bachelor’s degree from the University of Florida, and then returned to Ft. Lauderdale to attend law school at Nova Southeastern University, where he graduated cum laude.

Brandon is a member in good standing with The Florida Bar and The American Bar Association. He is admitted to practice law in all courts in the State of Florida and is admitted to practice at the Federal level of the United States District Court, Middle and Southern Districts of Florida. In addition, he is involved with The Young Lawyers Division of the Florida Bar, The B’Nai B’rith Justice Unit, and The Palm Beach County Justice Association.

Q. Can I get into trouble for almost hitting a pedestrian and almost causing an accident at the same time?
A: I am uncertain if you are worried about the footage being used for a personal injury lawsuit by the pedestrian or as grounds for giving you a traffic ticket. To answer your questions directly, though, yes, they could turn over the footage. It seems unlikely that the driver would turn over the footage to the police for traffic ticket purposes of their own accord; it also seems unlikely that that footage would be used after-the-fact to issue you a citation. For purposes of the personal injury case, an "almost-accident" is not the same as an accident. You can't be liable for un-caused damages. However, I would suggest you pay much closer attention while driving. Florida is notorious for pedestrian accidents and injuries. Q. Florida Dog Bite, please help
A: I believe this is the same question as a previous question in Personal Injury, but with a bit more detail. As I said there, I would make a point that you do not feel comfortable discussing this without the woman who was injured present. Any claims for payment of her injuries would go through your homeowner's or renter's insurance, but I would assume they would also need full and correct paperwork to document the injuries and costs.
Q. Florida Dog Bite, what should I do?
A: You certainly did the right thing by filing a police report. Details of the situation and injuries should be included there just in case. As to the medical bills, if she is unresponsive, there isn't much you can do at the moment. If her boyfriend reaches out to you again, I would inform him that you need to speak directly with the woman who was injured since he has no legal authority in the situation. He can obviously be present, but it may be a situation where the boyfriend is pushing a situation that she'd be inclined to let go.
